Missing a scheduled court date is extremely serious. If you fail to appear, the judge can order your removal in absentia (without you present). That order is very difficult to overturn. Always attend your hearings, and if you move, file a change of address (Form EOIR-33) with the court immediately. Knowledge is power — consult an immigration attorney to understand the role of ICE agents versus the role of immigration judges.
You have the right to an attorney, but the government does not provide one for free. Many people choose to hire an immigration attorney to help them understand the law, properly file applications, and represent them in court.
Possible forms of relief from removal include:
- Asylum, Withholding of Removal, or CAT protection if you fear persecution or torture in your home country.
- Cancellation of Removal if you have been in the U.S. for many years, have good moral character, and your removal would cause extreme hardship to a qualifying family member.
- Adjustment of Status if you are eligible to apply for a green card through a family member or employer
- Voluntary Departure as an alternative to a removal order.
